The national response to the ongoing COVID-19 pandemic crisis has generated much public debate about how best to mobilize industry to fill shortages in critical medical equipment. Discussion has centered on the Defense Production Act of 1950, a powerful law granting the President broad authorities to direct private industry to support urgent national defense needs. The President has already invoked the Defense Production Act to require U.S. companies to manufacture ventilators and to prevent the export of medical personal protective equipment.
