The National Defense Industrial Association continues to follow all developments regarding COVID-19 and is diligently examining each event to determine the best course of action.
The health and safety of our members, registrants, exhibitors, and staff constitute our highest priority, and we will continually monitor reports from the U.S. Centers for Disease Control and Prevention (CDC), the World Health Organization (WHO), the U.S. Department of Defense (DoD), and the U.S. Office of Personnel Management (OPM) in order to adjust plans as needed.
NDIA is implementing all guidance and recommended safety measures issued by WHO, CDC, DoD, and OPM as well as state and local health authorities. We will work with all conference partners to ensure the safety of all meeting and conference participants.
All participants can expect to see heightened levels of cleanliness and on-site accommodations to actively encourage all participants to take common-sense precautions following CDC guidelines.
The CDC and WHO websites are the best resources for staying up to date on this rapidly evolving situation.

NDIA COVID-19 Policy Actions (Letter Links & Descriptions) & Important Information
10/20/2021 - P&R signed FHP #23, Rev 1, to address how the facility policy is applied to contractors with respect to EO 14042. Included below are the key highlights:
- “For DoD contractor personnel, the DoD civilian vaccination deadline of November 22, 2021, does not apply.” This addresses some early concerns from industry that some agencies were applying civilian vaccine requirements to contractors.
- Dedicated DD Form 3150 and instructions to present at facility entry to demonstrate vaccine status and requirement to keep on their person for facility entry. Specifically, “maintain a current completed DD Form 3150, and show it to authorized DoD personnel upon request. Failure to complete the DD Form 3150 may result in denying DoD contractor personnel access to the DoD facility to which access is sought.”
- “For COVID-19 testing of DoD contractor personnel with CRA, DoD Components will offer, if available, COVID-19 testing similar to that offered to DoD civilian employees at the DoD Component's expense and at no cost to the contractor personnel or the contractor.” To ensure a total force approach to testing, reduce complexity, churn, and added costs.
Additionally, we were informed today that DPC released Class Deviation 2021-O0009. The Deviation implements the requirements of Executive Order 14042 – Ensuring Adequate COVID Safety Protocols for Federal Contractors. The actions directed by the Executive Order will ensure parties who contract with the Federal Government provide adequate COVID-19 safeguards in workplaces with individuals working on or in connection with a Federal Government contract or contract-like instrument. The class deviation mandates all service contracts, including construction, above the Simplified Acquisition Threshold (SAT - $250k) include DFARS Clause 252.223-7999, Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors.
White House guidance “strongly encouraged” agencies to apply the clause in service contracts below SAT and contracts for the manufacturing of products, which include our supply contracts. Given the intent of the guidance, it’s DLA policy to include the clause in contracts where there is extended interaction with the DoD workforce regardless of dollar value or whether the contract is for services or supplies. For DLA, an example would be contracts within our Industrial Prime Vendor (IPV) program; supply contracts that include storage functions at the Service’s maintenance depot with contractor personnel filling bins throughout the shop floor.
You, our members, may have questions as DoD moves through the implementation. I encourage you to work closely with your respective contracting officers to resolve concerns while continuing to share them with NDIA. DoD released the attached Force Health Protection Guidance (Supplement 23) which will impact your contractor employees working in DoD facilities as soon as next week. Specifically, in accordance with the White House Safer Federal Workforce Task Force directed safety measures, attestation of an individual's status as fully vaccinated, or presentation of a recent negative COVID-19 test will be a condition of physical access to DoD facilities. Components are required to publish any necessary supplemental instructions and begin implementing the FHPG (Supp 23) attestation requirements no later than Sep 13, 2021, followed by implementation of the screening testing requirements based on the availability of testing supplies.

FHPG (Supp 23) Highlights:
Policy Application:
Applies to all individuals, including contractor personnel, issued a credential by DoD that affords the individual recurring access (classified in the memo as "credentialed recurring access" or CRA) to DoD facilities.
Does not apply to personnel receiving ad hoc access to DoD facilities (e.g. delivery personnel, or taxi services)
Does not apply to individuals who have access to the grounds of, but not into the buildings on, DoD Installations (e.g. contract groundskeepers, fuel delivery personnel, etc).
Policy Requirements
Individuals must, as a condition of physical access to DoD Facilities, attest their status as fully vaccinated or present a recent negative COVID-19 test
Personnel will attest to their vaccination status by completing the DD Form 3150 (attached).
DoD contractor personnel with CRA will:
Complete the DD Form 3150
Maintain a copy of the completed DD Form 3150 and show it to authorized DoD personnel, upon request.
Personnel who do not attest their status as fully vaccinated will enter their component testing program.
Individuals who refusal to submit to required screening testing will be denied access to DoD facilities
Screening testing requirements will be executed at least weekly with self-collection kits or self-tests that can be performed primarily onsite at the installation or facility. If onsite screening testing is not feasible, self-testing can be performed at home or in other locations. If the COVID-19 screening test is administered offsite, the negative result must be from a test performed in the past three days.
Components will procure and provide self-tests for DoD contractor personnel with CRA and establish guidance for where and how the tests will be distributed and conducted and how results are to be reported.
DoD contractor personnel with CRA will maintain a copy of their most recent COVID-19 test result and show such results to authorized DoD personnel, upon request.
Personnel (including contractor personnel with CRA), who have positive screening tests will be required to remain away from the workplace IAW existing DoD guidance. Components will offer, but not require, confirmatory laboratory-based molecular testing to individuals who have positive test results.
8/24/2021 - Federal Protective Service COVID-19 Guidance Update

Facilities Controlled by the Federal Protective Service
“Federal Protective Service COVID-19 Guidance Update”is effective Wed, Aug 25, 2021.
- This guidance applies to federal facilities (to include GSA leased/owned facilities and other Federal buildings), that are controlled/secured by the FPS.
o For example, FPS controls 11 facilities in the NCR alone, and many others throughout the country, where we have Service members, DoD civilian employees, and DoD contractor personnel in those GSA leased facilities.
- FPS may enforce vaccination and testing status attestations only after:
o Written signage is posted at each public entrance on the property (see attached Facility Access Signage).
o All occupying federal agencies developed and communicated internal policies and/or accommodations for their personnel (to include contractors) who are not vaccinated due to medical or religious reasons.
- These tasks will be accomplished facility by facility, so some facilities may begin enforcing attestations tomorrow, some may begin at a later date.
- Once these conditions are met,DoD personnel in FPS controlled facilities will be subject to the FPS entry guidance/requirements.
- Entry requirements for DoD contractor personnel working in FPS controlled facilities
o On-site contractors and visitors must present a Certification of Vaccination form (FPS will be using attached OMB vaccine certification format)
§ DoD has been told that FPS will have forms available on-site for personnel to complete at the entry point.
o FPS will ask the contractor if they possess the required paperwork (e.g., travel orders, official meeting appointment?) for entry into the facility as required by the signage.
o FPS personnel will not require contractors/visitors to provide proof of a negative COVID-19 tests, and the responsibility to assess compliance is with the specific agency associated with the contractor or visitor.
§ The forthcoming P&R implementation guidance will address testing requirements for all DoD personnel categories, to include frequency, and how to obtain tests. So, for now, DoD contractor personnel will have met all DoD requirements simply by completing the attestation form being requested by FPS or at GSA leased facilities.
o BOTTOM LINE: DoD contractor personnel should be able to enter FPC controlled facilities by simply completing the attestation form (for now).
- We expect that there will be some uneven implementation as this rolls out at FPS controlled facilities throughout the country, and have asked that our contracting officers/contracting officer’s representatives engage with building management to resolve issues as they arise.
Recap/Overview of new health protection & workforce Safety Measures
- POTUS directed new health protection and workplace safety measures in his 29 July briefing to prevent the transmission of COVID-19 during the ongoing pandemic (fact sheet attached).
- Following the President’s announcement, the Safer Federal Workforce Task Force updated their model safety principles (attached). Key updates to those principles are:
- In areas of high or substantial transmission, Federal employees, contractors, and visitorsmust wear a mask inside Federal buildings, except for the limited exceptions discussed in the section on F ace Masks and Physical Distancing below. Individuals who are not fully vaccinated must wear a mask regardless of community transmission level.
- Federal agencies need toask about the vaccination statusof Federal employees and “onsite contractors”—employees andonsite contractors must sign an attestation confirming their vaccination status, or they will be treated as not fully vaccinatedfor purposes of safety protocols. Federal agencies also must establish a program to test not fully vaccinated Federal employees and onsite contractors weekly or twice-weekly (TBD).
- Those Federal employees andonsite contractors who are not fully vaccinated or decline to provide their vaccination statusmustwear a mask, physically distance, and comply with a weekly or twice-weekly screening testing requirement, and are subject to Government-wide restrictions on official travel.
Way Forward for DOD:
OUSD(P&R) is finalizing guidance to implement additional force health protection (FHP) and workplace safety measures directed by the White House’s Safer Federal Workforce Task Force (attached) to reduce the transmission of COVID-19. Significantly, this forthcoming issuance will provide guidance on how to determine the COVID-19 vaccination status of Service members, DoD civilian employees, DoD contractor employees and official visitors, and outlines COVID-19 screening testing requirements for unvaccinated individuals in these personnel categories. So more to follow once that is final, what we wanted to share above is more pressing.

Q: Where can companies go for information on potential opportunities to support COVID requirements now that the JATF portal has closed?
During the current COVID-19 public health emergency, the JATF has provided assisted acquisition support to the Department of Health and Human Services (HHS). The JATF has used the industry portal as well and the Commercial Solutions Opening to solicit concepts from industry in support of domestic industrial capacity for HHS COVID-19 response priorities. At this time, DoD is not currently supporting a specific requirement from HHS for assisted acquisition. We encourage companies to monitor the HHS Broad Agency Announcement website https://www.phe.gov/ASPRNext/Pages/default.aspx and beta.SAM.gov for ongoing government requirements.
Q: Who can companies talk to about the CSO for PPE – specifically disposable gowns? The association was questioning the rejection of a disposable gown CSO submission.
As identified in the CSO, paragraph 1.6.1.j, Solutions Briefs that are not invited to a Spiral Phase 2 Oral Presentation or Spiral Phase 3 Request for CSP will be notified in writing as soon as practicable. Further verbal feedback may be provided, upon request, at the Contracting/Agreements Officer’s discretion. Debriefings to unsuccessful offerors shall be provided upon request in accordance with provisions and timelines of FAR 52.212-1.

- DPC Response:
- The reference in the P&R Force Health Protection Supplement 10 (11 June 2020) was intended to enable situations when Government testing requirements would be extended to contractor personnel working in shared workplaces for public health safety of the total force.
- A current example of exiting contractual coverage for medical screening is health screening requirements at deployment processing centers prior to deployment into the area of responsibility (AOR) for contractor personnel accompanying the force.
- DPC is working with the Office of the Under Secretary of Defense for Personnel and Readiness (OUSD(P&R)) and Health Affairs to both partner on any future requirements, but also examine the need for broader guidance to contracting officers on this specific topic.
Will there be any additional guidance to COs regarding this element of P&R’s Force Health Protection Supplement 10 (June 11, 2020)—specifically, the statement that: “Employees of DoD contractors will use the processes for medical care to access testing as set forth in the terms of the contract under which they are performing. As necessary, existing contracts should be modified to set forth processes to provide access to testing.”

6/24/2020 – Defense Production Act -- Memorandum of Agreement (MOA)- A&S and the U.S. International Development Finance Corporation (DFC) signed an MOA. The MOA formalizes the relationship between the two organizations as outlined in Executive Order 13922, which delegated authority to DFC to execute loans using DPA Title III in support of the response to COVID-19.

- The average time of DIB closures is 40.5 days; and the average time to reopen is 20.3 days.
6/11/2020 – On 11 June 2020, the Department release the attached Force Health Protection Guidance Supplements 10 and 11. Supplement 10 provides guidance on clinical diagnostic COVID-19 testing for eligible persons with DoD suspected of having contracted COVID-19. Supplement 11 provides guidance on the Department’s surveillance strategy for COVID-19, including health surveillance activities, screening, asymptomatic testing, and sentinel surveillance testing. - From Treasury’s FAQs: What is “a business critical to maintaining national security”?
A business critical to maintaining national security is one that, unless otherwise approved as set forth below, is at the time of the business’s application:
(1) performing under a “DX”-priority rated contract or order under the Defense Priorities and Allocations System regulations (15 CFR part 700); or
(2) operating under a valid top secret facility security clearance under the National Industrial Security Program regulations (32 CFR part 2004).
Applicants that do not satisfy either of these two criteria may be considered for loans if, based on a recommendation and certification by the Secretary of Defense or the Director of National Intelligence that the applicant business is critical to maintaining national security, the Secretary of the Treasury determines that the applicant business is critical to maintaining national security. Businesses that do not meet these criteria may nonetheless be eligible for assistance under other CARES Act programs.
- Per Treasury: Borrowers are encouraged to submit their completed application materials by 3:00 p.m. EDT on May 1, 2020, for expedited review. Applications received after 3:00 p.m. on May 1, 2020, may not be considered, but the Treasury Department may, in its discretion and subject to the availability of funds, consider such applications for approval.

4/24/2020 – USD(I) is closely monitoring the security challenges posed by the pandemic and stands ready to assist industry.
To that end, DoD has approved a number of companies to provide fingerprint services to the MilDeps, Agencies, and Industry. OUSDI&S learned that FieldPrint is the largest of the vendors with more than 1300 locations across the United States and its territories. DoD encourages those interested to go through the list of approved vendors to see which one best meets their needs.
